From the Memorandum and Order: "This case is one of many cases arising from the arrests of approximately 1,800 people during the Republican National Convention (the “RNC”) in New York City in the summer of 2004. Throughout the litigation, the City of New York and the individual defendants (collectively, the “City”) have withheld or redacted a number of documents requested by the plaintiffs on the basis of various privileges. On March 14, 2007, I granted in part and denied in part the plaintiffs’ motion to compel production of documents that the City claimed were subject to the self-critical analysis privilege, the attorney-client privilege, and the deliberative process privilege. MacNamara v. City of New York, No. 04 Civ. 9216, 2007 WL 755401 (S.D.N.Y. March 14, 2007). The plaintiffs now seek an order compelling the City to produce in unredacted form additional documents that the City has withheld on the basis of the deliberative process privilege and the law enforcement privilege. In addition, the plaintiffs seek an order reopening depositions at which the City instructed witnesses not to answer questions regarding the presence of undercover or plainclothes officers at demonstrations. For the reasons set forth below, the plaintiffs’ motion is granted in part and denied in part."

The cops - brass - and civilian commanders - the Mayor - should be charged for civil rights offenses. Last week a court ruled that the NYPD has admitted it has no evidence for arresting 23 out of 24 people in a mass roundup during the RNC. This ruling is a likely forecast of things to come in thousands of RNC false arrest lawsuits the city is facing for NYPD mass arrests made during the Republican National Convention period in NYC in 2004. UPDATE: Bail has been denied in the case of Daniel McGowan, and each of the other arrestees around the country. McGowan will be held pending his extradition to Eugene, Ore. and his arraignment.

According to spectators at Friday's hearing, prosecutors read through posts on the NYC Indymedia newswire (including this article) and mentioned them as part of the bail hearing. They made mention of other electronic communications on Thursday, and undoubtedly their attentions are ranging far and wide.

Please refrain from speculation and innuendo on Indymedia posts related to this case.

Federal marshals arrested six environmental activists in a series of coordinated raids in four states yesterday, Dec. 8, in apparent response to a string of arsons in Oregon and Washington attributed to the Earth Liberation Front (ELF), including simultaneous attacks in 2001 at the University of Washington's Urban Horticulture Center and the Jefferson Poplar Farms in Clatskanie, Oregon. Daniel McGowan, 31 was arrested in New York City. Authorities have also stated that there will be more arrests, with at least one indictment immediately outstanding.

One of Tejas Bloc 7 goes to trial in January in NYC

On Wednesday 15 December Houston area Peace and Social Justice activist, Stephen Boudreaux (in the middle of the top row in the picture), was ordered by a NYC Criminal Court Judge to stand trial for 2 counts of disturbing the peace stemming from his arrest on the evening of 31 August (A31) during the Republican National Convention (RNC) protest. Stephen’s jury trial is set for January 6th 2005.

Stephen was in a group of approximately 65 activists, including an Affinity Group of 6 other members of the Tejas Bloc, who had moments before departed Union Square enroute to Madison Square Garden (MSG) to protest the criminal actions of the Bush administration. The group was stopped on E 17th Street at 5th Avenue by NYPD barricades manned by officers from the 81st precinct. Negotiations quickly ensued between the ad hock group’s leaders and the NYPD watch commander. After about a 30-minute wait, the police suddenly charged from behind the barricades, with motorcycles in the lead and forced the group onto the south sidewalk where they were arrested, hand cuffed and taken to Pier 57.

Many out-of-town activists arrested on A31 accepted an ACD (Adjournment in Contemplation of Dismissal), which is a deal that requires the arrestee to not get arrested again in NYC for 6 months in return for a reported espongement of their arrest records. Stephen however refused this offer and pleaded Not Guilt to the charges of Blocking Traffic and Failure to Disperse. Asked why he chose to fight the charges rather than to accept the ACD, Stephen said, “I will represent all of those who could not afford to return to New York and fight these bullshit charges. Our 1st Amendment rights to freedom of assembly, freedom of speech, and freedom to redress the government are routinely trampled upon by the fascist Bush Administration and its minions. We did not block either pedestrian or vehicular traffic, since the street was blocked off on the east end by traffic cones and on the west end by the police barricades, nor did we refuse to disperse since a dispersal order was never given.” Stephen went on to say that as the father of 2 daughters he has an obligation to set an example of peaceful resistance to the stripping of our constitutional rights and the dangerous precedence of pre-emptive arrest being set by the Bush administration. Meanwhile, in New York the first jury trial of a protestor arrested during the RNC ends in a dissmisal, as the District Attorney drops all charges after viewing photographic and video evidence that arresting officer Matthew Wohl may have lied numerous times under oath.

Secret Service Attempts Subpoena For Indymedia Logs as Part of Harassment Campaign

As was reported in today's New York Times, the Department of Justice has opened a criminal investigation and is demanding records concerning anti-RNC deleagte posts to this website. Specifically, the DOJ is seeking information on lists of 2,200 RNC delegate names posted to our Open Newswire.

NYC Indymedia believes that this investigation is wholly without merit, and is part of a larger campaign of intimidation against our supporters and peaceful protest activities surrounding the RNC.

Additionally, NYC Indymedia does not keep the records that the DOJ is seeking. According to Global Indymedia, "as a result of [previous] attempts to violate our clear rights, we felt it prudent to develop a policy of not voluntarily gathering data for the government on people who visit our websites, or who post material to sites. '. . . we do not log IP addresses as a way of protecting the privacy of our visitors. . .'

Those of us at New York Indymedia feel, first and foremost, that this site is in the business of media-making and journalism. We invite first time visitiors to look around, and we hope they like what they see.

Secret Service Attempts Subpoena for Indymedia Logs

Grand Jury Subpoenas NYC Indymedia Logs The Justice Department has opened a criminal investigation and is demanding records regarding NYC Indymedia posts that list the names of Republican delegates and urge protesters to "unwelcome" them to New York City. Federal prosecutors said in a grand jury subpoena that the information was needed as part of a Secret Service investigation into possible "voter intimidation."



It appears the FBI and Secret Service are once again engaging in a fishing expedition to route out dissenting viewpoints, harass people exercising their free speech rights, and intimidate others from exercising their right to protest the Republican National Convention. "We can't see any legitimate purpose behind this investigation, and it looks to us like another attempt to repress legitimate political dissent," says Ann Beeson, associate legal director for the ACLU, which is representing Calyx, an internet service provider for NYC Indymedia.



Aside from Indymedia, the information on RNC delegates can also be found in the RNC's official media guide packet, various state Republican Party websites, and a variety of media sources.



The ACLU says it plans to hand over to federal officials on Monday the subpoenaed information on Indymedia's contacts and account at Calyx, but is unable to reveal who posted the delegates' names, because Indymedia does not log identifying information of its contributors.
